PLEASE READ CAREFULLY. BY SIGNING THIS DOCUMENT, YOU CHOOSE TO WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
High Point Pool (HPP) (Owner of Property, Releasees)
HPP pool facilities is for members of HPP and authorized guest only, I recognize and fully understand certain things, including:
• Regardless of whether there is a lifeguard on duty, you are responsible for the safe operation of the pool and are responsible for all persons under your membership and guests thereto using the pool and/or HPP facilities and HPP property generally.
• My use of the pool facilities involves certain risks, including but not limited to:
1. The risk of injury resulting from the possible malfunction of the pool equipment;
2. The risk of injuries resulting from tripping or falling over obstacles in the pool area;
3. The risk of injuries resulting from unsupervised divers and swimmers colliding;
4. The risk of other injuries resulting from participating in any action in the pool.
5. The risk of activities requiring physical skills and sound judgment.
• I recognize and fully understand that the above list is not a complete or exhaustive list of all possible risks; the list only provides examples of types of risks that I am assuming.
In exchange for the PL allowing me to utilize the pool and pool areas, I hereby agree to the conditions below. I fully intend and choose to give up the legal rights, as stated below:
1. TO WAIVE ANY AND ALL CLAIMS that I have or may have in the future against HPP, its directors, officers, employees, agents, or representatives (hereinafter referred to as the “Releases”) relating to my use of the pool and pool area;
2. TO RELEASE THE RELEASES from any and all liability for any loss, damage, injury, expense, or other costs that I may suffer or that my next of kin may suffer in connection with my use of the Releases pool or pool area to any cause whatsoever, INCLUDING NEGLIGENCE ON THE PART OF THE RELEASES;
3. TO HOLD HARMLESS AND INDEMNIFY THE RELEASES from any and all liability to property, or personal injury to, any third party, resulting from the use of the pool or pool area
4. That I am over the age of 18 and that I am responsible and will adhere to all the rules of the property. If under 18, a parent/ guardian must sign before use alone and membership must reflect the use of each participant. Guests must also have a waiver. You are responsible and shall be liable for any actions or omissions of your guests.
5. That this Waiver, Release, and Agreement is fully effective and shall be effective and binding upon me, and my heirs, next of kin, executors, administrators, and assigns, or anyone else authorized to act on my behalf or on behalf of my estate.
I have read and understood this document. I am aware that by signing this document, I am waiving certain legal rights that I may have against the Releases, and I fully agree to do so.
Pool Safety Checklist:
No running.
No diving unless expressly permitted by lifeguards or in accordance with HPP rules.
Supervise kids. Young children should be monitored by an adult at all times.
Toddlers must wear swim diapers.
No pool floatation devices unless permitted by lifeguards or in accordance with HPP.
No animals in the pool area.
No glass bottles.
MEMBER ONLY POOL ACCESS.
WATER SPICKETS ARE EMPLOYEE USE ONLY.
MUST BE 13 TO SWIM WITHOUT AN ADULT.
YOU ARE RESPONSIBLE FOR THE ACTIONS OF YOUR GUESTS, WHO MUST BE AUTHORIZED AND REGISTERED AT THE FRONT DESK
MUST CHECK IN EVERY TIME AND HAVE A WAIVER ON FILE TO SWIM.
I realize that participating in any physical activity is physically demanding and potentially hazardous. I agree to abide by any decision of the event organizer relative to my ability to participate. I assume all risks associated with my participation in the physical activities while on the premises, which risks may include, but are not limited to, contact with other participants, falls, personal injuries, sickness, death, disability, damage to tangible or intangible personal property, as well as the effects of weather and traffic. I have read this waiver and, knowing these facts and in consideration of my election to participate in this event, I, for myself, my minor children, if applicable, and anyone entitled to act on my behalf, waive and release the pool and its directors, officers, agents, contractors, volunteers and sponsors (collectively, the “Releasees”) and will indemnify, defend and hold Releasees harmless from all claims and liabilities of any kind, including any claims by third parties, arising out of my participation in this activity. I acknowledge that I am at least 18 years old, and am voluntarily participating in such events. If my/our minor child participates in the activity, I acknowledge and assume all risks associated with their participation in this activity.
